    Philips CPAP Recall Lawsuit

Recalled Breathing Machines May Have Caused Cancer

    Read About This Case

    What Happened?

In June 2021, Philips Respironics issued a massive recall of approximately 15 million CPAP machines, BiPAP machines, and mechanical ventilators because the polyester-based polyurethane (PE-PUR) sound abatement foam used in these devices was found to degrade over time, releasing black particulate matter and volatile organic compounds (VOCs) directly into the air pathway. Philips knew about the foam degradation problem as early as 2015 but did not recall the products for six years, during which millions of users continued to breathe degraded foam particles every night.

    Who Qualifies?

You used a Philips Respironics CPAP, BiPAP, or ventilator included in the June 2021 recall for at least one year. You have been diagnosed with cancer (particularly lung, trachea, larynx, nasal/sinus, liver, or kidney cancer), or respiratory disease worsening.

    Primary Diagnoses:

Lung CancerHighest priority — directly linked to inhaling degraded foam particles and VOCs nightly.
Throat / Larynx CancerFoam particles passed through the throat airway during use.
Nasal / Sinus CancerDirect exposure pathway for nasal CPAP mask users.
Liver CancerDMIA (a degradation product) is associated with liver toxicity.
Kidney CancerVOC exposure linked to renal cell carcinoma.

    Litigation Status

MDL 3014 is consolidated in the Western District of Pennsylvania. Philips filed for bankruptcy protection for its North American Respironics subsidiary in 2024 to manage the litigation. Settlement negotiations are ongoing through the bankruptcy process.

    Estimated Compensation

Cancer cases — especially lung and respiratory cancers in plaintiffs who used the device for many years — are the highest priority. Estimated values for cancer cases: $50,000-$500,000+ depending on cancer type, severity, age, and total device use duration.

    Frequently Asked Questions

How do I find out if my specific device is recalled?
Visit recall.philips.com and enter your device serial number. Most DreamStation, SystemOne, and REMstar models are affected.
Do I need to have kept the device?
Keeping the device helps but is not required. Your sleep medicine records, DME provider records, and insurance claims will show what device you used.
What if I have sleep apnea but no cancer?
Most firms are focusing on cancer cases. Severe respiratory conditions may qualify in some cases.
    Does smoking affect my case?
Non-smokers with lung cancer have the strongest cases, but smokers are not automatically disqualified.
Who is liable — Philips or my equipment supplier?
Philips Respironics is the manufacturer and primary defendant. Your DME supplier is not typically a defendant.
What about the replacement devices Philips sent?
Philips offered repair kits and replacement devices. Accepting a replacement does not waive your right to sue for injuries caused by the original defective device.
The recall came out after I stopped using my CPAP — do I still qualify?
Yes. If you used a recalled Philips device for any period, you were exposed to the degrading foam. Cancer can develop years after exposure.
How long does a CPAP lawsuit take?
The bankruptcy process may accelerate resolution for some claims, but complex mass torts typically take 2-5 years.
