What Happened?
In June 2021, Philips Respironics issued a massive recall of approximately 15 million CPAP machines, BiPAP machines, and mechanical ventilators because the polyester-based polyurethane (PE-PUR) sound abatement foam used in these devices was found to degrade over time, releasing black particulate matter and volatile organic compounds (VOCs) directly into the air pathway. Philips knew about the foam degradation problem as early as 2015 but did not recall the products for six years, during which millions of users continued to breathe degraded foam particles every night.
Who Qualifies?
You used a Philips Respironics CPAP, BiPAP, or ventilator included in the June 2021 recall for at least one year. You have been diagnosed with cancer (particularly lung, trachea, larynx, nasal/sinus, liver, or kidney cancer), or respiratory disease worsening.

MDL 3014 is consolidated in the Western District of Pennsylvania. Philips filed for bankruptcy protection for its North American Respironics subsidiary in 2024 to manage the litigation. Settlement negotiations are ongoing through the bankruptcy process.
